ARCHIBALD TAILORING - SUIT SALES TERMS AND CONDITIONS

These Terms and Conditions apply to all purchases of suits, formalwear, accessories and related products from Archibald Tailoring.

  1. DEFINITIONS

In these Terms and Conditions:

"Archibald Tailoring", "we", "us" and "our" means Archibald Tailoring, Prince Bishops, Durham.

"Customer" means the person purchasing goods from Archibald Tailoring.

"Collection Date" means the date agreed for collection of the goods.

"Deposit" means the payment made to secure an order.

"Final Fitting Date" means the date agreed for the Customer to attend a fitting prior to collection.

"Goods" means any suits, jackets, trousers, waistcoats, shirts, accessories or other products purchased from Archibald Tailoring.

"Order" means the purchase of Goods from Archibald Tailoring.

"Order Date" means the date on which the Customer places an order.

"Special Order Goods" means goods ordered specifically for the Customer which are not held as standard stock.

  1. FORMATION OF CONTRACT

2.1 An Order is placed when the Customer completes an order form and pays the required Deposit.

2.2 Acceptance of an Order occurs when Archibald Tailoring confirms the Order and accepts payment of the Deposit.

2.3 These Terms and Conditions form part of the contract between Archibald Tailoring and the Customer.

  1. DEPOSITS AND PAYMENT

3.1 A minimum deposit of 50% of the total purchase price is required when placing an Order.

3.2 The balance of the purchase price must be paid in full no later than six (6) weeks prior to the Final Fitting Date, unless otherwise agreed in writing.

3.3 Archibald Tailoring reserves the right not to order, manufacture or release Goods until all required payments have been received.

3.4 Ownership of the Goods shall not pass to the Customer until payment has been received in full.

  1. SPECIAL ORDERS

4.1 Goods ordered specifically for the Customer may require advance payment.

4.2 Special Order Goods may differ slightly from samples displayed in store due to manufacturing tolerances, fabric batches and supplier specifications.

4.3 Once a Special Order has been placed with a supplier, the Order may not be cancelled without charge.

4.4 Deposits paid for Special Order Goods are non-refundable except where required by law.

  1. FITTINGS AND MEASUREMENTS

5.1 The Customer is responsible for attending all fitting appointments.

5.2 Measurements recorded by Archibald Tailoring are based on the Customer's size at the time they are taken.

5.3 If the Customer's measurements change after the Order is placed, Archibald Tailoring cannot guarantee that replacement sizes will be available without additional cost of 50% unless these items are already held in our current shelf stock. 

5.4 The Customer must inspect and try on all Goods during fittings and notify Archibald Tailoring of any concerns before collection.

5.5 By signing the fitting documentation, the Customer confirms satisfaction with the fit, sizing and alterations completed.

5.6 For children and young persons, updated measurements may be required before final fitting due to expected growth. This appointment should be 6 weeks prior to the collection date. Following this fitting the clauses of this contract shall apply. 

  1. ALTERATIONS

6.1 Alterations shall incur extra charges 

6.2 Alteration services are provided based upon measurements taken at the time of fitting.

6.3 Once altered, Goods may become non-returnable unless faulty or not as described.

6.4 Alterations may be carried out by approved third-party specialists. This may require travel within a 10 mile radius.

  1. CHANGES TO ORDERS

7.1 Any request to amend an Order must be made as soon as possible.

7.2 Archibald Tailoring reserves the right to charge reasonable administration, supplier, alteration or restocking fees resulting from changes requested by the Customer.

7.3 Changes requested after supplier orders have been placed may not be possible.

  1. CANCELLATION

8.1 Orders for stock items may be cancelled before supplier ordering or alteration work has commenced, subject to any costs already incurred.

8.2 Deposits may be retained to cover reasonable losses resulting from cancellation.

8.3 Once Special Order Goods have been ordered, manufactured, customised or altered for the Customer, cancellation charges up to the full value of the Order may apply.

8.4 Nothing in these Terms affects the Customer's statutory rights.

  1. COLLECTION OF GOODS

9.1 Archibald Tailoring will notify the Customer when Goods are available for collection.

9.2 The Customer is encouraged to contact the store before travelling to confirm availability.

9.3 Goods should be collected within thirty (30) days of notification unless otherwise agreed.

9.4 Archibald Tailoring reserves the right to charge reasonable storage fees for Goods left uncollected for extended periods.

  1. RETURNS AND EXCHANGES

10.1 The Customer's statutory rights are unaffected.

10.2 Stock items purchased in-store may be exchanged or credited within twenty-eight (28) days of purchase provided they are:

(a) unworn;

(b) unused;

(c) in original condition; and

(d) accompanied by proof of purchase.

10.3 Refunds for in-store purchases are not normally offered unless Goods are faulty, not as described, or otherwise required by law.

10.4 Special Order Goods, customised garments and altered garments are non-returnable and non-refundable unless faulty.

10.5 For hygiene reasons, shirts, ties, pocket squares and certain accessories may not be eligible for return once worn.

  1. PRODUCT AVAILABILITY

11.1 All Orders are subject to supplier availability.

11.2 Where a product becomes unavailable due to circumstances beyond our control, Archibald Tailoring reserves the right to provide a comparable alternative or provide a refund for the unavailable item at their own discretion.

  1. QUALITY AND FAULTS

12.1 Archibald Tailoring warrants that Goods supplied will be of satisfactory quality, fit for purpose and as described in accordance with applicable consumer legislation.

12.2 Any faults should be reported as soon as reasonably possible after discovery.

12.3 Archibald Tailoring reserves the right to inspect any Goods reported as faulty before providing a repair, replacement or refund.

  1. LIMITATION OF LIABILITY

13.1 Nothing in these Terms excludes or limits liability for:

(a) death or personal injury caused by negligence;

(b) fraud or fraudulent misrepresentation; or

(c) any liability that cannot lawfully be excluded.

13.2 Subject to clause 13.1, Archibald Tailoring's total liability arising from any Order shall not exceed the amount paid by the Customer for the relevant Goods.

13.3 Archibald Tailoring shall not be liable for indirect or consequential losses.

  1. DELAYS

14.1 Archibald Tailoring will not be held in breach of contract where delays incur due to circumstances outside their control provided services can be completed withing 48 hours of the event date. 

  1. DATA PROTECTION

15.1 Archibald Tailoring processes personal information in accordance with applicable UK data protection legislation.

15.2 Customer information is used solely for administering Orders, arranging fittings, processing payments and communicating regarding purchases.

15.3 Personal information will not be disclosed to third parties except where necessary to fulfil an Order or where required by law.

15.4 Customer records will be retained only for as long as reasonably necessary and then securely deleted or destroyed.

  1. GOVERNING LAW

16.1 These Terms and Conditions shall be governed by the laws of England and Wales.

16.2 Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

ARCHIBALD TAILORING

SUIT HIRE TERMS AND CONDITIONS

These Terms and Conditions apply to all suit hire bookings made with Archibald Tailoring, Prince Bishops, Durham.

1. DEFINITIONS

In these Terms and Conditions:

"Archibald Tailoring", "we", "us" and "our" means Archibald Tailoring, Prince Bishops, Durham.

"Booking" means the reservation of one or more hire garments and/or accessories.

"Collection Date" means the date agreed between Archibald Tailoring and the Hirer for collection of the hire garments.

"Deposit" means the initial payment required to secure a Booking.

"Function Date" means the date of the event for which the garments are hired.

"Fitting Date" means the date arranged for the Hirer and any members of the Hirer's party to attend a fitting appointment.

"Gentleman's Quarter" means Archibald Tailoring's private hire space and customer lounge.

"Hire Deposit" means the refundable security deposit payable upon collection of the garments.

"Hire Period" means the period commencing on the Collection Date and ending on the Return Date.

"Hirer" means the person entering into the hire agreement on their own behalf or on behalf of a group.

"Order Date" means the date upon which Archibald Tailoring places an order with its supplier for garments or accessories relating to the Booking.

"Return Date" means the first day on which Archibald Tailoring is open following the Function Date, unless otherwise agreed in writing.

2. FORMATION OF CONTRACT

2.1 A Booking is made when the Hirer completes an order form and pays the required Deposit.

2.2 Upon payment of the Deposit, a legally binding contract is formed between the Hirer and Archibald Tailoring.

2.3 The Hirer confirms that they have read and accepted these Terms and Conditions at the time of booking.

3. DEPOSIT AND PAYMENT

3.1 A minimum Deposit of 50% of the total hire charge is required to secure a Booking.

3.2 Any outstanding balance must be paid no later than six (6) weeks prior to the Fitting Date.

3.3 If payment is not received by the due date, Archibald Tailoring reserves the right to suspend, amend or cancel the Booking and may decline to place any supplier orders required to fulfil the Booking.

3.4 All prices are stated in pounds sterling (£).

4. PURCHASE OF ACCESSORIES

4.1 Accessories purchased outright are not hire items and must be paid for in full at the time of purchase.

4.2 Stock accessories may be exchanged or credited within twenty-eight (28) days of purchase provided they remain unused, in original condition and suitable for resale.

4.3 Where accessories are specially ordered at the customer's request, an additional special order charge of up to 25% may apply.

4.4 Specially ordered accessories may not be refundable unless faulty or otherwise required by law.

5. CHANGES TO BOOKINGS

5.1 Any request to amend a Booking must be submitted as soon as possible.

5.2 Archibald Tailoring reserves the right to charge reasonable administration, supplier, alteration or replacement costs arising from any amendment requested by the Hirer.

5.3 Any changes requested after the Order Date may be subject to additional charges.

6. FITTINGS

6.1 The Hirer is responsible for attending all scheduled fitting appointments.

6.2 The Hirer is encouraged to contact the Durham store before travelling to confirm that garments are available for fitting.

6.3 All garments, excluding shirts where applicable, must be tried on during the fitting appointment.

6.4 The Hirer must sign the fitting documentation confirming satisfaction with sizing and fit.

6.5 If any member of the Hirer's party experiences a change in size after fitting but before the Order Date, it is the Hirer's responsibility to arrange a further fitting appointment.

6.6 Where additional garments, replacements or alternative sizes are required due to changes in measurements after fitting, additional charges may apply.

6.7 If replacement garments must be sourced externally because suitable stock is unavailable, Archibald Tailoring reserves the right to charge up to 50% of the replacement garment cost.

6.8 All replacement garments must be inspected and tried on before collection.

6.9 Due to growth-related size changes, children should be measured approximately four (4) weeks prior to the Function Date.

7. CANCELLATION

7.1 The Hirer may cancel a Booking at any time by notifying Archibald Tailoring in writing.

7.2 If a Booking is cancelled before the Order Date, Archibald Tailoring may retain an amount representing any costs already incurred.

7.3 If a Booking is cancelled after the Order Date, the Deposit shall be non-refundable.

7.4 If a Booking is cancelled within one (1) month of the Fitting Date, Archibald Tailoring reserves the right to charge 50% of the total hire cost for each suit ordered.

7.5 If a Booking is cancelled within seven (7) days of the Fitting Date, the full hire cost for all ordered garments shall become payable.

7.6 Any refund due shall be processed within a reasonable period following cancellation.

7.7 Nothing in this clause affects the customer's statutory rights.

7.8 In exceptional circumstances, Archibald Tailoring may, at its sole discretion, offer a partial or full refund. Such circumstances do not ordinarily include a change of mind, obtaining products elsewhere, or cancellation of the event itself.

8. GROUP BOOKINGS

8.1 The Hirer shall be responsible for coordinating all members of the group.

8.2 Unless otherwise agreed, all fittings, collections, payments and returns must be completed through the Durham store.

8.3 Where one individual collects garments on behalf of other members of the party, the Hirer accepts responsibility for all garments collected and any resulting loss, theft or damage.

8.4 Archibald Tailoring shall not be responsible for delays or issues arising from the failure of group members to attend fittings, provide measurements or comply with these Terms and Conditions.

9. COLLECTION OF GARMENTS

9.1 The Hirer is encouraged to contact the Durham store before travelling to confirm availability of the garments.

9.2 Following successful fitting and completion of any necessary adjustments, a Collection Date will be agreed.

9.3 Unless otherwise agreed, garments will normally be available for collection up to two (2) days before the Function Date.

9.4 The Hirer must notify Archibald Tailoring at the time of booking if garments are required earlier than the standard collection period.

9.5 Early collection requests are subject to availability and may incur an additional hire charge of 50% of the standard hire rate per additional week or part thereof.

10. HIRE DEPOSIT

10.1 A refundable Hire Deposit is payable upon collection as follows:

(a) £100 per adult three-piece suit; and

(b) £50 per child three-piece suit.

10.2 The Hire Deposit will normally be refunded to the original payment method within twenty-eight (28) days of the Return Date.

10.3 The Hire Deposit may be reduced or withheld where deductions are required under these Terms and Conditions.

11. CLEANING AND RETENTION OF HIRE DEPOSIT

11.1 Normal wear and reasonable use are included within the hire charge.

11.2 Where garments require additional specialist cleaning due to excessive staining, smoke odour, misuse or neglect, Archibald Tailoring reserves the right to deduct cleaning charges from the Hire Deposit.

11.3 Typical cleaning deductions are:

(a) £25 per suit where one specialist cleaning treatment is required; and

(b) £50 per suit where multiple specialist cleaning treatments are required.

11.4 Archibald Tailoring shall determine the level of cleaning required acting reasonably.

12. EXTENDED HIRE

12.1 Subject to availability, the Hire Period may be extended.

12.2 Extended hire shall be charged at 50% of the standard hire rate for each additional week or part thereof.

13. RETURN OF GARMENTS

13.1 All garments must be returned on the Return Date.

13.2 Failure to return garments by the Return Date shall result in a late return charge of £20 per suit for each day or part day that the garments remain outstanding.

13.3 Late return charges do not limit Archibald Tailoring's right to recover further losses arising from non-return of garments.

14. CARE OF GARMENTS

14.1 The Hirer must take reasonable care of all hired items.

14.2 Garments must not be altered, repaired, modified or cleaned by the Hirer without prior written consent.

14.3 Garments must be protected from avoidable damage, excessive staining and misuse.

15. LOSS, THEFT OR DAMAGE

15.1 The Hirer shall be responsible for the replacement cost of any hired item that is:

(a) lost;

(b) stolen;

(c) destroyed; or

(d) damaged beyond economical repair.

15.2 Archibald Tailoring may deduct such costs from the Hire Deposit and recover any remaining balance from the Hirer.

16. NON-STANDARD SIZING

16.1 Standard hire pricing applies to regular stock sizes only.

16.2 Where specialist sizing, alternative fits or non-standard garments are required, an additional charge of up to 25% per garment may apply.

17. ALTERATIONS

17.1 Temporary alteration services may be available subject to garment suitability and timing.

17.2 Alterations may be carried out by Archibald Tailoring or approved third-party contractors.

17.3 Alteration services cannot be guaranteed and remain subject to availability.

18. STOCK AVAILABILITY

18.1 Archibald Tailoring shall use reasonable endeavours to supply the garments selected by the Hirer.

18.2 Where garments become unavailable due to supplier shortages, discontinuation or circumstances beyond our reasonable control, Archibald Tailoring reserves the right to provide a substantially similar alternative of comparable quality and style.

19. LIMITATION OF LIABILITY

19.1 Nothing in these Terms and Conditions excludes or limits liability for:

(a) death or personal injury caused by negligence;

(b) fraud or fraudulent misrepresentation; or

(c) any liability that cannot lawfully be excluded under English law.

19.2 Subject to clause 19.1, Archibald Tailoring's total liability arising from any Booking shall not exceed the total amount paid by the Hirer under the relevant contract.

19.3 Archibald Tailoring shall not be liable for indirect or consequential losses including loss of enjoyment, disappointment, accommodation costs, travel costs or loss of opportunity.

20. DATA PROTECTION AND PRIVACY

20.1 Archibald Tailoring will process personal data in accordance with applicable UK data protection legislation, including the UK General Data Protection Regulation and the Data Protection Act 2018.

20.2 Personal information provided by the Hirer and members of the Hirer's party will be used solely for:

(a) processing and administering the Booking;

(b) communicating regarding fittings, collection and returns; and

(c) fulfilling contractual obligations.

20.3 Personal information will not be disclosed to third parties except where necessary for the provision of hire services, legal compliance or the protection of legitimate business interests.

20.4 Customer records will be retained only for as long as reasonably necessary for business and legal purposes and will then be securely destroyed.

21. GOVERNING LAW

21.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

21.2 Any dispute arising from or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
